Administrative service description

 

A working capacity is established for adult applicants from 18 years of age until a retirement age, and for individuals under 18 years of age who are (were) insured with the state social insurance after a complex assessment of medical as well as of individual's performance and ability to participate criteria.

After establishing a working capacity of 0-55 % for an individual, the territorial division of the DWCAO issues:

  • Disability Certificate
  • Certificate of capacity level or certificate of occupational diseases
  • The nature and conditions for work;
  • A recommendation regarding a need for assistance.

A certificate is also issued to the individuals with a working capacity of 60 % and more when the reasons of a working capacity are as follows:

  • accident (mutilation) at work;
  • occupational disease;
  • disease (mutilation) acquired during service or training;
  • disease (mutilation) that resulted from aggressive actions that were taken against the citizens of the country during the period from the 11th to 13th of January 1991 and subsequent events; 
  • disease (mutilation) due to the effects of the Chernobyl nuclear power plant emergency response works;
  • disease (mutilation) acquired during the actions of resistance to occupation of 1940-1990;
  • disease (mutilation) acquired during illegal detention and exile;
  • disease (mutilation) acquired during a service in the active armies of Anti-Hitler coalition states, partisan squads and groups during the World War Second;
  • disease (mutilation) acquired as result of detention in ghettos, concentration camps or forced camps of other types;
  • disease (mutilation) acquired as result of forced works;
  • disease (mutilation) acquired as result of performing the duty of the citizen;
  • disease (mutilation) acquired during military service or military training in the Soviet army.

Regulations applying to the provision of the administrative service

Law on Social Integration of the Disabled of the Republic of Lithuania XI-1488;

Order No. A1-139/V-356 On Approval of the Description of Criteria for the Capacity for Work Level Assessment and Procedure Capacity for Work Level Assessment, of 21 March 2005 of the Minister of Social Security and Labour of the Republic of Lithuania and the Minister of Health of the Republic of Lithuania.

The Order No A1-92 of the Minister of Social Security and Labour of the Republic of Lithuania of 4 April 2005 on the Approval of the forms of the certificates of the level of a working capacity, of the level of a working capacity due to an accident at work or occupational disease, of the level of disability and of the Description of the procedure of their issue.

6.

Information and documents to be submitted by the individual

 

Information and documents to be provided by an applicant:

  • An application on capacity for work level assessment;
  • A filled in a referral to DCWS;
  • Medical analyses extracts proving the disease gravity and the diagnosis, extracts of the Clinical record of hospital treatment, Personal health records and other medical documents;
  • A passport or Personal Identity Card of the citizen of the Republic of Lithuania or of the Member State of the European Union, a passport or a residence permit in the Republic of Lithuania, a temporary residence permit in the Republic of Lithuania issued in accordance with the legislation of the Republic of Lithuania as to an alien intending to work in the Republic of Lithuania a work that requires high professional qualification, a temporary or permanent residence permit in the Republic of Lithuania issued after the granting of asylum in the Republic of Lithuania, except when an electronic service of this type is provided via the state e-Government System and an applicant applies electronically for the establishment of the level of a working capacity. When an individual lodges an application electronically, the applicant shall confirm his / her identity by means of electronic signature or by other means laid down in the legal acts of the Republic of Lithuania;
  • the documents confirming educational background, specialty, qualification of the individual.
  • 1 photo ( 3x4 cm).

Additional documents describing the nature of the disorder of the body's functions:

  • in case of movement disorders – informing on the Barthel Index, functional independence test, pain evaluation scale, assessment of the muscle condition, the degree of movement disorder;
  • in case of mental diseases and disorders – informing on the personal intelligence coefficient (IQ), the Mini mental test performed, a psychological personality test, all confirming the degree of imbecility, behavioural, emotional, will-related and other disorders;
  • in case of vision and hearing disorders – informing on the special control tests confirming the degree of visual and / or hearing impairments;
  • in case of speech disorder – the speech test;
  • if an individual referred is an officer of the internal service system, the recommendation to refer to the DWCAO issued by the Central Medical Expertise Commission of the Medical Centre under the Ministry of the Interior of the Republic of Lithuania must be additionally provided.

In case of the following reasons of the level of a working capacity:

  • concerning an accident at work – an investigative act of an accident at work and, when necessary, other documents specified in the Rules for establishing the level of a working capacity related to the accidents at work or effects of occupational diseases approved by the Order of the Minister of Social Security and Labour of the Republic of Lithuania and of the Minister of Health of the Republic of Lithuania;
  • concerning an occupational disease – an investigative and confirmatory act of occupational disease and, when necessary, other documents specified in the Rules for establishing the level of a working capacity related to the accidents at work or effects of occupational diseases approved by the Order of the Minister of Social Security and Labour of the Republic of Lithuania and of the Minister of Health of the Republic of Lithuania;
  • concerning disease (mutilation) acquired during the service or training - medical and military documents in the prescribed form. When necessary, the judicial decision or judgement in the pre-trial investigation, the document of other competent authority confirming that the accident is related to the person injured (mutilated) and his/her service;
  • concerning disease (mutilation) in relation to the events of January 11-13 of 1991 and the USSR aggression that followed afterwards - a certificate of legal status of the Independence Defender issued by the municipality, and a certificate issued by the General Prosecutor’s Office of the Republic of Lithuania confirming the fact of injury caused at the time of defending the freedom of the Republic of Lithuania in 1991;
  • concerning disease (mutilation) acquired because of an effect of Chernobyl nuclear power plant emergency response works – documents confirming participation (a military ID, a certificate from the military authority or referral from the working place), the certificate issued by the municipality confirming that the person participated in combatting Chernobyl nuclear power plant effects, and the conclusion from the Specialist Commission for determining  linkage of disease to participation in combatting Chernobyl nuclear power plant effects the composition of which is approved by the Minister of Health;
  • concerning disease (mutilation) acquired by political prisoners, exiles and persons who are equivalent to them, participants in the resistance to the occupations of 1940-1990 - the appropriate legal status certificates issued by the Genocide and Resistance Research Centre of Lithuania; the individuals who during the World War II were taken for forced works, or who were held in ghettos, concentration camps or coercive camps of other type – the certificate issued by the Prosecutor General’s Office of the Republic of Lithuania or by the Ministry of the Interior; the individuals who during the World War II served in the active armies of Anti-Hitler coalition states, partisan squads and groups – the certificate from the Ministry of National Defence;
  • concerning disease (mutilation) as result of performing the duty of the citizen – the documents confirming that the disease (mutilation) resulted from performance of the duty of the citizen;
  • concerning disease (mutilation) acquired during military service or military training in the Soviet army – the documents confirming that the disease (mutilation) arose during the military service or military training in the Soviet army, i.e. a military document of the person confirming the mandatory military service or military training in the Soviet army, a military-medical document confirming the disease or mutilation, or a document issued by the medical facility confirming a slowly progressing disease that was diagnosed within 5 years of the service in the army, or the decision of the medical consilium formed of psychiatrists of the personal health care facilities providing inpatient psychiatric services that confirms a slowly progressing mental disease that is associated with the service during the Soviet–Afghan War.

Referral, application and other necessary documents to DWCAO shall be submitted within 60 calendar days after the day that the referral was filled in. 

The aforementioned documents can be submitted to the DWCAO by:

  • an individual, his/her parents, spouse, adult children, custodians (guardians) or other individuals authorized by him/her, or by a social worker of the municipality of residence who represents an individual, or by a social worker of a social care institution in which an individual lives, and this can be done upon arrival to the DWCAO or by sending by a registered mail;
  • by a physician who is responsible for the treatment of an individual if the documents are in an electronic form.

Copies of submitted personal documents may be certified by DCWS specialists. This requires having original personal documents.

If the documents are sent by registered mail, personal document copies must be notarized, or certified by an elder or a consular officer of the Republic of Lithuania.

Issue of a disability certificate

Administrative service description 

The disability level assessed for individuals under 18 years except for individuals who have (had) State Social insurance coverage.

Disability level is assessed complexly by evaluating individual’s health condition, possible independence in daily activities and opportunities to develop oneself, impact of environmental factors and other important aspects.

The disability level is assessed based on the referral to DWAO issued for an individual by a health care institution, where explicit data about individual’s health condition is provided as well as based on medical and other documents. Individual’s activity and ability to participate questionnaires are filled in.  An individual (children at the age of 4-18 years old) and (or) parents (foster-parents), caretakers, guardians answer  the questions of the questionnaire.

Documents may be submitted directly by arriving to the Disability and Working Capacity Assessment Office under the Ministry of Social Security and Labour (hereinafter – DWCAO), by sending it through registered mail or through courier. 

Territorial division of the DWCAO, upon adopting a decision on the extract of individual’s disability level and issues (sends):

  • Note on disability level;
  • Certificate of the disabled.

Decision adopted by the territorial division of the DWCAO may be appealed to the Director of DWCAO:

  • within 30 calendar days after documentation delivery or dispatch to the individual, when an individual disagrees with the decision adopted by the DWCAO territorial division;
  • within 90 calendar days after notification of pension or benefits paying institution, when the pensions or benefits paying institution disagrees with the decision adopted by the DWCAO territorial division.

5.

Legal acts applying to the provision of the administrative service

Law on Social Integration of the Disabled of the Republic of Lithuania XI-1488;

Order No. V-188/A1-84/ISAK-487 On Approval of the Description of the Criteria and Procedure for the Disability Level Assessment, dated on 23 March 2005, of the Minister of Social Security and Labour of the Republic of Lithuania, the Minister of Health of the Republic of Lithuania, and the Minister of Education and Science of the Republic of Lithuania.

6.

Information and documents to be submitted by the individual

The following documents are to be submitted for assessment of the disability level:

  • A filled in referral to DWCAO (the referral is valid for 60 days after the day that it was filled in);
  • Medical analyses extracts (instrumental and laboratory), proving the disease gravity and diagnosis; if there is a need, extracts of the Clinical hospital treatment record(form No. 003/a) and Personal health records (form No. 025/a). 

Additional documents describing the nature of bodily dysfunctions:

  • in case of mobility disorders - informing about the Barthel index, the functional independence measure test, the pain assessment scale, the muscular condition assessment, the degree of mobility dysfunction; 
  • in case of mental diseases and disorders - informing about the personal intellectual coefficient (IQ); the completed Mini Mental Test, a psychological personality analysis, the ones proving the degree of mental handicap, behavioral, emotional, will and other disorders;
  • in case of visual and hearing disorders - informing about special control tests, confirming the degree of visual and (or) hearing disorders;
  • in case of language dysfunction - informing about the conclusion on language assessment.  

The previously indicated documents may be submitted to the DWCAO by:

  • Individual’s parents (foster-parents), guardians or caretakers;
  • Doctor treating the individual, if the documents are in an electronic form.

Note: an individual shall submit an application and other necessary document also in such case if the referral was filled and submitted to the DWCAO online.

Individual’s parents (foster-parents), guardians or caretakers shall additionally submit the following documents to the DWCAO:

  • An application to assess the disability level (for the individuals up to 18 years old) (an application may be filled in by arriving to the DWCAO or by filling in an online application form and printing it out;
  • A personal identification document of a person for whom the disability level is assessed (passport of the Republic of Lithuania or passport, ID card or permission to live in the Republic of Lithuania) and (or) a birth certificate if a child was born before 1 January 2017, a personal identification document of an authorised person (passport of the Republic of Lithuania or passport, ID card or permission to live in the Republic of Lithuania)   except for the cases when such a service is provided through e-Government system, and application on the assessment of the disability level is filled in online;
  • If applicable, a certificate of a Pedagogical-Psychological Service or Educational Service regarding the primary/ repeated pedagogical-psychological assessment of special educational needs (except for needs arising due to exceptional abilities) applying pedagogical, psychological, medical and social pedagogical aspects listed in the description of order confirmed by the Order No. V-1775 of the Minister of Education and Science of the Republic of Lithuania dated on 30 September 2011;
  • 1 photo (3x4 cm).

If documents are submitted by caretakers (guardians), a personal identification document (passport of the Republic of Lithuania or passport, ID card or permission to live in the Republic of Lithuania) of the caretaker (guardian) are to be additionally submitted.

Copies of submitted personal documents are made and certified by the DWCAO specialists. This requires having original copies of personal documents.

If the documents are sent by registered mail, copies of the personal documents must be notarized in a manner established by legal acts, or certified by an elder or a consular officer of the Republic of Lithuania.

Note: Referral, application and other necessary documents to DWCAO shall be submitted within 60 calendar days after the day that the referral was filled in.

When the decision of the DWCAO territorial division is appealed, the DWCAO reassess the disability level and adopts the decision within 30 calendar days after the day of receiving all the necessary documents.

Assessment of special needs

Administrative service description 

The individuals listed below have the right to the establishment of special needs: the citizens of the Republic of Lithuania; the citizens of another Member State of the European Union or of the country party to the Agreement on the European Economic Area and their family members who have been issued with the documents confirming their right to reside in the Republic of Lithuania; individuals who, in accordance with the regulations of the European Union for coordinating social security schemes, are subject to the Law of the Republic of Lithuania on Social Integration; foreigners holding a long-term European residence permit of the Republic of Lithuania, and foreigners granted asylum in the Republic of Lithuania. 

Special needs are established in accordance with the Description of the procedure for the establishment of a special need for a permanent nursing, of a special need for a permanent care (assistance), of special needs for the compensation of costs of acquisition a passenger car and its technical adaptation approved by the Order of the Minister of Social Security and Labour of the Republic of Lithuania and of the Minister of Health of the Republic of Lithuania without taking into consideration the age of the individual, a degree of disability or working capacity.

Special needs are established:

  • for the individual, other than those who reached the age of riterement in the presence in the office. In the case if predicted basic functioning level is less than 20 points and because of the disfunction of the body the individual  is uncapable to arrive in DWCAO he is inspected at home, hospital or social care institution he lives at the moment.
  • for the individuals that reached the age of retirement, are able not participate in the procedure of assesment when the documents necessary to identify special needs are not in doubt of the need of permanent care (assistance) or permanent nursing.
  • in the absence of the person when for the the establishment of a special needs of a person residing abroad is addressed by the institution paying the pension or benefit.

Special needs are asseted by evaluating the complex level of functioning, medical documents (information), the criteria for a person’s activity and ability to participate (by completing a questionnaire for the assessment of individual activity and ability to participate). The questionnaire is filled in by the employee of DWCAO during the conversation with the person for persons of working age and persons aged 4 to 18 years. For the individuals that reached the age of retirement the questionnaires are filled by an employee appointed by the administration of the municipality where the person lives.

If an individual whose special needs are being assessed fails to arrive to the DWCAO without justified reasons when is invited to attend in or refuses to participate in the procedure of assessment of special needs, the special needs of such individual are not assessed.

Special needs are also not assessed when the DWCAO applies to the Personal Healthcare Facility that employs the physician who has issued a referral to the DWCAO for the purpose of establishing special needs or to other facilities or institutions for additional medical documents (information), and the Personal Healthcare Facility that employs the physician who has issued a referral to the DWCAO for the purpose of establishing special needs or other facilities or institutions inform that the individual without a justified reason refuses from additional examination.

The following special needs may be established for individuals:

  • The need for a permanent nursing;
  • The need for a permanent care (assistance);
  • The need for the compensation of costs of acquisition of a passenger car and its technical adaptation.

The special needs for a permanent nursing and care (assistance) can be of two degrees:

  • a first degree need for nursing is established for an individual whose constant, irreversible dysfunction of the body results in disability that completely restricts self-reliance, orientation and movement of the individual, and who requires a permanent nursing 8 hours a day or for a longer duration);
  • a second degree need for nursing is established for an individual whose constant, irreversible dysfunction of the body results in disability that significantly restricts self-reliance, orientation and movement of the individual, and who requires a permanent nursing 6-7 hours a day;
  • a first degree need for a permanent care (assistance) is established for an individual whose constant, irreversible dysfunction of the body results in disability that partially restricts self-reliance and participation in public life of the individual, and who requires a permanent assistance of other individuals 4-5 hours a day;
  • a second degree need for a permanent care (assistance) is established for an individual whose constant, irreversible dysfunction of the body results in disability that slightly restricts self-reliance and participation in public life of the individual, and who requires a permanent care (assistance) for nor more than 3 hours a day.

In case an individual confirms in writing that he / she refuses from an assessment of a need for the compensation of costs of acquisition of a passenger car and its technical adaptation, a need of this type shall not be assessed and no decision shall be adopted regarding it.

Deadlines for establishing special needs:

The following deadlines apply for the establishment of special needs for a permanent nursing and for a permanent care (assistance):

  • for a period of 6 months when a special need for a permanent nursing, a special need for a permanent care (assistance) and a degree of special needs are assessed for the first time, and the change in the state of the health of the individual or in his / her self-reliance in daily activities is forecasted within the next six months;
  • for a period of one year when a special need for a permanent nursing, a special need for a permanent care (assistance) are assessed for the first time and/or the change in the state of the health of the individual or in his / her self-reliance in daily activities is forecasted within the next 12 months;
  • for a period of 2 years when the change in the state of the health of the individual or in his / her self-reliance in daily activities is forecasted within the next 24 months;
  • for an indefinite period of time when the change in the state of the health of the individual or in his / her self-reliance in daily activities is not forecasted and/or the health disorders of the individual are permanent, constant by their nature.

The following deadlines apply for the establishment of a special need for the compensation of costs of acquisition of a passenger car and its technical adaptation:

  • for a period of 6 years when a special need for the compensation of costs of acquisition of a passenger car and its technical adaptation is established and the change in the state of the health of the individual is forecasted within the next 72 months;
  • for an indefinite period of time when the change in the state of the health of the individual or in his / her self-reliance in daily activities is not forecasted and/or the health disorders of the individual are permanent, constant by their nature.

A degree of special needs shall be established following the establishment of special needs for individuals of retirement age.

  • A degree of significant special needs is established for the individuals for whom a special first and second degree need for a permanent nursing has been established.
  • A degree of average special needs is established for the individuals for whom a special first degree need for a permanent care (assistance) has been established.
  • A degree of low special needs is established for the individuals for whom a special second degree need for a permanent care (assistance) has been established.

Decision adopted by the territorial division of DWCAO may be appealed to the Director of DWCAO:

  • within 30 calendar days after the day of receiving the certificate, when a person disagrees with the decision adopted by the DWCAO territorial division;
  • within 90 calendar days after notification of pension or benefits paying institution, when the pension or benefits paying institution disagrees with the decision adopted by DWCAO territorial division.

When the individual or the institution paying target compensations disagrees with the decision of the Director of DWCAO regarding the reassessment of special needs, this decision may be appealed within 30 days from the day of receiving the certificate (the institution paying target compensations was informed) to the Contention Commission under the Ministry of Social Security and Labour.

5.

Legal acts applying to the provision of the administrative service

Special needs shall be assessed on the basis of the Order No. A1-765/V-1530 On Approval of the Description of Procedure for the Needs Assessment to Compensate Special Costs for Regular Nursing, Acquiring and Technical Adaptation of a Passenger Car, as well as Transport Costs, of 27 December 2018 of the Minister of Social Security and Labour of the Republic of Lithuania and the Minister of Health of the Republic of Lithuania.

6.

Information and documents to be submitted by the individual

The following documents should be provided by the applicants who apply for the establishment of special needs:

  • a completed referral to the DWCAO (a referral is valid for a period of 60 calendar days from the date on which it has been completed);
  • extracts of medical tests/examinations (instrumental, laboratory) confirming the severity of the disease and the diagnosis, when necessary – extracts from the medical records of treatment in the inpatient department (form No 003/a), medical records of the individual (form No 025/a) and other documents, depending on the functional impairment of the individual;
  • an application for the establishment of special needs (an application can be also completed at the DWCAO or on the website of the DWCAO at www.ndnt.lt and printed out). When an individual is unable to write and / or sign an application for the establishment of special needs by himself / herself due to his / her state of health, the application can be drafted and signed by the representative of that particular individual.
  • A passport or Personal Identity Card of the Republic of Lithuania, or a passport, or a residence permit in the Republic of Lithuania, and/or a birth certificate (of children under 16) if a child was born before 1 January 2017, a document certifying the identity of an authorized person (a passport or Personal Identity Card of the Republic of Lithuania, or a passport, or a residence permit in the Republic of Lithuania, except when an electronic service of this type is provided via E-Government Gateway system and the applicant applies online for the establishment of special needs.
  • Individuals of retirement age should provide a photo with a size 3 x 4cm.

Note: an application and other aforementioned documents must be provided by an individual or his / her representative even though a referral addressed to the DWCAO has been lodged by a physician electronically.

If the documents are sent by registered mail, copies of the personal documents must be notarised, or certified by an elder or a consular officer of the Republic of Lithuania. 

Note: Referral, application and other necessary documents to DWCAO shall be submitted within 60 calendar days after the day that the referral was filled in.

 Assessment of professional rehabilitation needs

Administrative service description 

Professional rehabilitation means restoring or developing of the individual's working capacity, professional competency and ability to participate in the labour market by educative, social, psychological, rehabilitation and other measures of influence. 

Professional rehabilitation needs are assessed for persons, who:

  • Cannot work the previous work based on the acquired professional qualification without these services;
  • Or other work, meeting their professional qualification;
  • Or to acquire new professional qualification;
  • Or to perform work required in the new professional qualification;
  • Because of illness, health condition or bodily dysfunctions. 

Professional rehabilitation needs are assessed:

  • For individuals, who apply to DWCAO for the assessment of capacity for work level for the first time;
  • For individuals with the assessed capacity for work level, by applying to the DWCAO with the referral from the Employment Servise under the Ministry of Social Security  and Labor and an application to assess the professional rehabilitation needs.  

Professional rehabilitation needs are assessed based on the referral to DWCAO issued by a health care institution, where detailed data is provided about individual’s health condition, as well as based on submitted medical and other documents as well as individual’s motivation to participate in professional rehabilitation program and to be active in order to be employed after finishing the program.

Decision adopted by the territorial division of DWCAO may be appealed to the Director of DWCAO:

  • within 30 calendar days after documentation delivery or dispatch to the individual, when a person disagrees with the decision adopted by the DWCAO territorial division;

When the professional rehabilitation needs are assessed when assessing individual’s capacity for work level for the first time, the individual does not need to provide additional documents to the DWCAO other than the ones necessary to assess the capacity for work level.

Individuals with the assessed capacity for work level, apply for the professional rehabilitation needs with the referral from the Employment Servise under the Ministry of Social Security  and Labor, an individual shall submit or send the referral by registered mail to the territorial division of DWCAO not later than within 3 business days from the day of receiving the referral from the Territorial Labour Exchange to DWCAO to assess the professional rehabilitation need. An individual shall additionally submit or send by registered mail the following documents: (Copies of submitted personal documents are made and certified by DWCAO specialists. If the documents are sent by registered mail, copies of the personal documents must be notarised, or certified by an elder or a consular officer of the Republic of Lithuania):

  • A personal identification document (passport of the citizen of the Republic of Lithuania, or an ID card, or a permit to permanently reside in the Republic of Lithuania) except the cases when the E -Government system provides this e-service type and the professional rehabilitation needs assessment is applied for electronically. An individual submitting an electronic application shall confirm his (her) identity with an e-signature or in other ways specified in the legal acts of the Republic of Lithuania;
  • An application “On Assessment of professional rehabilitation needs”.

Equating disability groups to the capacity for work level

Administrative service description 

Equating disability group to the capacity for work level shall be assessed for individuals until they reach the age for the old-age pension, who had Disability Groups I, II or III with or without the period of disability assessed before the Law on Social Integration of the Disabled came into force (on 1 July 2005). 

The disability groups are equated to:

  • Disability Group I shall be equated to 20% of the capacity for work level; 
  • Disability Group II shall be equated to 35% of the capacity for work level; 
  • Disability Group III shall be equated into 50% of the capacity for work level. 

For individuals who had a disability group assessed without the established period, the existing disability group is equated to the capacity for work level based on disability certificates issued under the procedure which was in force before the Law came into force (before July 1, 2005). For all the individuals who had a disability group with a period of disability assessed before the Law came into force (before July 1, 2005), the capacity for work level shall be assessed only after the end of the assessed disability period.

DWCAO territorial division, after adopting a decision on equating the disability level writes out and issues (sends):

  • Certificate of the disabled;
  • Certificate of working capacity level and (or) Certificate of working capacity because of  an Occupational Accident or Occupational Disease;
  • Conclusion on the nature and conditions of work.

If an individual disagrees with equating the disability level to the capacity of work level, (s)he may apply to the DWCAO on assessment of capacity for work level in a manner established by legal acts.

Issuing the parking cards for people with disabilities

Administrative service description 

A parking card for people with disabilities means a card entitling individuals to stop (park) in places dedicated for people with disabilities or places where stopping (parking) is not banned by the Traffic Regulations of the European Union  Member State, where they are at the moment. 

The following have the right to acquire this card:

  • Individuals of the working age with 0 to 25% of the capacity for work level assessed;
  • Individuals of the working age with 30% of the capacity for work and who drive cars themselves;
  • Individuals having reached the pension age, who before reaching it had 30% of the capacity for work level assessed and who drive passenger cars themselves;
  • Individuals having reached the pension age with the high level of the special needs assessed;
  • Individuals below 18 with a high disability level assessed;
  • Individuals with special needs (special need for permanent care, special need for permanent care / assistance, special need for reimbursement of purchase and technical adaptation of a passenger car, special need for reimbursement of transport costs).

Parking cards for people with disabilities are issued and replaced by the territorial division of the Disability and Working Capacity Assessment Office under the Ministry of Social Security and Labour (hereinafter – DWCAO).

Document may be provided by directly arriving to the DWCAO, by sending it through registered mail or through a courier.

A parking card for people with disabilities shall be issued based on the Order No.V-127 On Approval of the Description of the Procedure of a Parking Card Issuing for People with Disabilities, of 6 November 2009 of the Director of the Disability and Capacity for Work Service under the Ministry of Social Security and Labour.

The individual, who has lost or otherwise missing the Certificate of the Capacity for Work Level, the Certificate of the Capacity for Work Level due to an Occupational Accident or Occupational Disease, the Certificate of the Disability Level, Certificates of the Special Needs Assessment, the Special Need to Compensate for Costs of Acquiring and Technical Adaptation of a Passenger Car Certificate; the Special Need to Compensate for Transport Costs Certificate, the Certificate of the Disabled or the Parking Card for the People with Disabilities (hereinafter - the documents), must submit a written application to DWCAO to issue the duplicate document.

Individuals shall apply to the territorial division of the DWCAO based on their place of residence with a written application to issue the duplicate document. Documents may be submitted directly, upon directly arriving to a territorial division of DWCAO, by sending them by post or by courier.

Since 1 January 2006 the Certificates of the Disabled are issued and replaced by territorial divisions of DWCAO, where the decisions on the capacity for work level or the disability level of the individual are made.  

The certificate shall be replaced, if:

  • The certificate holder has a different name, surname;
  • The old certificate has become unsuitable for use;
  • The certificate contains inaccurate records;
  • The certificate is lost;
  • New certificate issued.

Replacement of documents issued by the Disability and Working Capacity Assessment Office under the Ministry of Social Security and Labour when the expiry date of the documents coincides with the date when person reaches his/her retirement age.

Administrative service description 

As of 1 January, 2012 retirement age has been extended in Lithuania; therefore, holders of disability certificate with indicated date of their retirement age and those who reached their retirement age after 1 January, 2012 will be able to get their disability certificates/ parking cards of the disabled replaced at the Disability and Working Capacity Assessment Office under the Ministry of Social Security and Labour (DWCAO).

Other documents issued by the DWCAO shall also be replaced if there is a need.

The examination of personal complaints and reports

The Disability and Working Capacity Assessment Office (DWCAO) under the Ministry of Social Security and Labour accepts and examines the applications and complaints of natural persons and legal entities (hereinafter – individuals) setting out an individual's attitude to a particular issue, reporting on the improvement or deficiencies of the DWCAO activities, and present suggestions how they should be corrected, notify on abuse or unlawful acts of civil servants and employees working under employment contracts that are not related to the violation of the particular individual’s legitimate interests and rights, pay attention to a particular situation, other appeals of individuals; requests (complaints) to perform a repeated assessment for establishing the disability level, the level of a working capacity and the special needs and their level when an individual disagrees with the relevant decision of the territorial division of the DWCAO.

A request (complaint) to perform a repeated assessment for establishing the disability level, the level of a working capacity and the special needs and their level if an individual disagrees with the decision of the territorial division of the DWCAO can be submitted to the Director of the DWCAO within 30 calendar days following the date of receipt of such the decision.

Requests (complaints) in writing can be submitted directly upon arrival by an individual or his/her representative to any territorial division of the DWCAO, by sending a request (complaint) by mail or by electronic means, electronically via a dedicated system, by fax or e-mail.

Personal requests (complaints) can be submitted to the DWCAO by e-mail to the address info@ndnt.lt or verbally directly upon arrival by an individual or his/her representative to any territorial division of the DWCAO.

Personal requests (complaints) sent to the DWCAO by electronic means must be signed with a qualified electronic signature or must be formed using electronic means that allow ensuring the integrity and irreplaceability of the text, except where, without prejudice to the interests of an individual applying, of other individuals or institutions, the requests of individuals may be answered promptly.

Written and verbal complaints can be submitted during the entire working day of the DWCAO, and on each Wednesday – during two additional office hours after the working day of the institution.

If the DWCAO is not competent to deal with the issues set out in the request (complaint), the request shall be forwarded at the latest within 5 working days following the date of its receipt for the examination to the competent authority by informing the applicant thereof in writing.

It must specify the applicant’s forename, surname, address (in case a natural person applies) or name, code, registered office address (in case a legal entity applies), and contact details, the content of the request, the suggestions that are desired to be presented, information or opinion must be set out in a comprehensive manner.

Requests (complaints) to review the decision of the territorial division of the DWCAO regarding the levels of a working capacity and disability shall be examined within 30 calendar days; regarding the special needs and their level – within 20 calendar days.

If due to objective reasons a repeated assessment cannot be carried out within this deadline, the Director of the DWCAO or a person authorized by him may extend the deadline for assessment (regarding the levels of a working capacity and disability – for 15 calendar days, regarding the special needs and their level – for 10 working days). An individual shall be notified in writing on the deadline extension.

Other requests and complaints shall be examined within 20 working days.

Upon receipt of all documents that are necessary for the repeated assessment of disability, the DWCAO carries out the assessment and adopts the decisions within 15 calendar days.

Establishment of a degree of special needs for individuals for whom a working capacity was established before they have reached a retirement age

Administrative service description

A degree of special needs is established for an indefinite period of time after reaching a retirement age for an individual for whom a working capacity level was established before he / she has reached a retirement age:

  • if a working capacity of 0-30 % was established, a degree of significant special needs shall be established for such individual;
  • if a working capacity of 35-55 % was established, a degree of average special needs shall be established for such individual.

The period of a degree of special needs begins to run from the day when the individual reaches retirement age.

The degrees of special needs that are listed below can be established for an individual for whom special needs were established after the individual has reached a retirement age until 31 December 2018, but their degrees were not established:

  • a degree of significant special needs – in cases where a special need of permanent nursing or a special need for a permanent care (assistance) has been established;
  • a degree of average special needs - in cases where a special need for the compensation of costs of acquisition of a passenger car and its technical adaptation has been established;
  • a degree of low special needs – in cases where a special need for the compensation of transport costs has been established.

After adopting a decision regarding a degree of special needs, the territorial division of the DWCAO shall not later than within 3 working days from the date of the decision inform an individual in writing of the decision adopted and shall issue (send) a disability certificate.

If an individual for whom a degree of special needs has been established in accordance with this procedure applies for the establishment of special needs, a degree of special needs shall not be repeatedly established for this applicant, except when a higher degree of special needs can be established through the establishment of special needs.

If a representative of an individual applies on behalf of the latter, the representative must specify his / her forename, surname, place of residence in an application and must enclose a documentary evidence of representation, must also specify particulars of an individual represented such as his / her forename, surname, place of residence and sign an application. An application can be lodged directly at the territorial division of the DWCAO, in writing, electronically. An application submitted by electronic means of communication must be signed with a secure electronic signature of an applicant or the applicant must confirm his / her identity by other secure means (for example, via online banking system).

An application submitted by electronic means of communication must be signed with a secure electronic signature of an applicant or the applicant must confirm his / her identity by other secure means (for example, via online banking system).

Administrative service description

The Disability and Working Capacity Assessment Office under the Ministry of Social Security and Labour (hereinafter – the DWCAO) publishes information on the activities of the DWCAO, the services provided and other relevant information on the website of the DWCAO www.ndnt.lt.

An individual may make a verbal presentation of a request to the DWCAO (by telephone (see the list here) or directly upon arrival to the DWCAO), or may submit a request in writing (by post or through a courier, by sending an e-mail message to info@ndnt.lt, by the Internet (www.ndnt.lt/KLAUSIMAI).

If possible, the verbal requests shall be answered immediately. If a verbal request presented by an individual cannot be answered on the same day, the individual shall be enabled to set forth a request in writing.

Verbal requests for information shall be presented in a language that is understandable to the individual and the staff member who provides service to the individual. If an individual does not know and understand the state language and there is no staff member who understands the language in which the individual applies, or when due to a sensory or speech disorder an individual is unable to convey his/her thoughts in an understandable way, when such an individual applies verbally, he/she must be accompanied by an individual who is able to interpret the request in the state language (an interpreter). An interpreter shall be invited by an applying individual at his/her own initiative.

The written requests of individuals must be written in the state language or translated to the state language, and the authenticity of their translation shall be certified in accordance with Law of the Republic of Lithuania on the Notariate, they must be written legibly, must indicate in particular what information is requested, a request must specify the forename, surname, place of residence or other contact details of the applicant according to which an individual wishes to receive an answer. If a request or complaint does not specify the mailing address to which an answer should be sent to an applicant, an answer shall be sent as per other contact details of the individual specified in the request. 

Personal requests received at the DWCAO that are written in a language other than the state language shall be examined by the decision of the Director of the DWCAO or of an individual authorized by the Director. Should a decision be made not to examine a request (complaint) of the individual that is written in a language other than the state language, such the request shall be returned to the applicant within 5 working days and the applicant shall be provided with information in the state language on the reasons of the return of the request.

If the data contains in the request made in writing are incomplete or inaccurate, the DWCAO shall contact the applicant within 5 working days of the date of receipt of the request to review and clarify the request.

If another institution has the disposition of the information requested, a personal request shall at the latest within 3 working days of the date of its receipt at the DWCAO be forwarded to such institution and the applicant shall be notified thereof within 3 working days of forwarding of the request.

An individual having submitted a personal identification document or having otherwise confirmed his / her identity in the manner prescribed by legal acts of the Republic of Lithuania has the right to receive information about himself / herself.

When an individual sends a request for information about him/her by post or through a courier, it must be accompanied with a copy of a personal identity document certified by the Notary Public or in accordance with other procedure established by the legal acts of the Republic of Lithuania.  

If a request is submitted by the representative of an individual, the representative must submit a document to confirm the representation.

Regulations applying to the provision of the administrative service

The Law of the Republic of Lithuania on the Right to Obtain Information from State and Municipal Institutions and Agencies, 11 January 2000, No VIII-1524 (new version from 1 April 2017).

The resolution No 875 of the Government of the Republic of Lithuania of 22 August 2007 on the Approval of the Rules for the examination of requests and complaints, and service of individuals at the public administration entities (new version from 23 November 2017).

An individual must submit a signed request that must specify the applicant’s forename, surname, address or other contact details (in case a natural person applies) or name, code, registered office address (in case a legal entity applies), contact details, what information the applicant wishes to receive, the desired way of receipt of information.
