Capacity for work assessment level 

A working capacity is established for adult applicants from 18 years of age until a retirement age, and for individuals under 18 years of age who are (were) insured with the state social insurance after a complex assessment of medical as well as of individual's performance and ability to participate criteria.

The right to the assessment of the capacity for work level is acquired by the citizens of the Republic of Lithuania, the citizens of another Member State of the European Union or of the country party to the Agreement on the European Economic Area and their family members who have been issued with the documents confirming their right to reside in the Republic of Lithuania, individuals who, in accordance with the regulations of the European Union for coordinating social security schemes, are subject to the Law of the Republic of Lithuania on Social Integration, foreigners holding a long-term European residence permit of the Republic of Lithuania, and foreigners granted asylum in the Republic of Lithuania.

After establishing a working capacity of 0-55 % for an individual, the territorial division of the DWCAO issues:

  • Disability Certificate
  • Darbingumo lygio pažyma ar (ir) darbingumo lygio dėl nelaimingo atsitikimo darbe ar profesinės ligos pažyma
  • Išvada dėl darbo pobūdžio ir sąlygų.

A certificate is also issued to the individuals with a working capacity of 60 % and more when the reasons of a working capacity are as follows:

  • accident (mutilation) at work;
  • occupational disease;
  • disease (mutilation) acquired during service or training;
  • disease (mutilation) that resulted from aggressive actions that were taken against the citizens of the country during the period from the 11th to 13th of January 1991 and subsequent events; 
  • disease (mutilation) due to the effects of the Chernobyl nuclear power plant emergency response works;
  • disease (mutilation) acquired during the actions of resistance to occupation of 1940-1990;
  • disease (mutilation) acquired during illegal detention and exile;
  • disease (mutilation) acquired during a service in the active armies of Anti-Hitler coalition states, partisan squads and groups during the World War Second;
  • disease (mutilation) acquired as result of detention in ghettos, concentration camps or forced camps of other types;
  • disease (mutilation) acquired as result of forced works;
  • disease (mutilation) acquired as result of performing the duty of the citizen;
  • disease (mutilation) acquired during military service or military training in the Soviet army.

The capacity for work level shall be assessed:

  • When an individual participates in the examination at the territorial division of the Disability and Capacity for Work Service (hereinafter – DWCAO) or when the examination is performed at the individual’s home (hospital) in cases when the forecasted basic capacity for work is 0-25% and the individual can not visit DWCAO.
  • In the absence if the individual, when documentary submissions cause no doubt that the forecasted basic capacity for work is 0-15% and the individual can not visit DWCAO. In certain cases DWCAOmay decide to invite the individual to participate when identifying his (her) capacity for work level.

Periods for assessing the capacity for work level:

  • for six months, when the capacity for work level is assessed for the first time and a quick change in the individual’s health condition, professional and functional factors, influencing the capacity for work level of an individual are forecasted within the next 6 months;
  • for one year, when the capacity for work level is assessed for the first time and (or) the change in the individual‘s health condition, professional and functional factors, influencing the capacity for work level are forecasted within the next 12 months;  
  • for two years, when the change in the individual’s health condition, professional and functional factors, influencing the capacity for work level of an individual are forecasted within the next 24 months as well as for individuals who are studying and are under 26 years of age;
  • up to completion of a professional rehabilitation programme, when a person is assessed with a need of a professional rehabilitation;
  • up to the date of reaching the old-age pension, when the change in the individual’s health condition and professional as well as functional factors, which influence the capacity for work level of an individual are not forecasted and (or) the personal health problems are of permanent and fixed nature;
  • without setting a period, when the capacity for work level is assessed due to  an occupational accident or occupational disease.

DWCAO shall re-assess the capacity for work level:

  • Before the end of the determined period of capacity for work, but no later than the last day of the period of capacity for work;
  • Upon the change of the individual’s health condition, or causes for the capacity for work level;
  • When the individual and/or an institution paying pension payments or benefits disagrees with the decision passed by DWCAO;
  • When implementing a decision of the Dispute Commission under the Ministry of Social Security and Labour;
  • In case of reasonable doubts concerning the assessment of the capacity for work level or upon clarifying that the decision of DWCAOwas unjustified.
